In a candid interview, Senior Judge John L. Kane (U.S. District Court for the District of Colorado) declared that the roadmap of Americas civil justice system--the Federal Rules of Civil Procedure--should be junked. He advocated working with futurists to design a legal system that meets the needs of 21st century Americans.

  • Kane at 1:10 'a person really isn't heard, the government just says this is what will happen'. Well John I guess your statement that public interest is best served by the free exchange ideas, and then saying you won't comment on my proposed change, would fit precisely in that category, i.e.

    Government says: 'We need the free exchange of ideas'

    What they mean: 'Further letters will not be read'.

    More legal reform issues at 'Colorado Bailin'.

    So I asked him his thoughts on my proposal to increase transparency at the chief judge level. His answer: 'I am not in the business of telling the chief justice how to operate the state court system...further letters will not be read...'

    So John, why did you say we need the free exchange of ideas?

  • Reported in Oct.2011 lawweek online, Judge Kane describes his job as: "I still sit in a courtroom and watch lawyers, but two things are different now: First, my main interest is not learning how to try a case, but wondering what some nut will say next. Second, this time I get to grade the papers."

    Your federal tax dollars at work? US district judge job is less like trying cases and more focused on classifying litigants as nuts? State judges are required to be impartial; maybe not US judges.
