I always thought of these films as still the early Batman years. He never thought Joker was a real threat until late in the film. The Batman in much of the comics was already a seasoned professional who has faced Joker many times.
Merc, Have, POH, I feel what you guys are saying but unfortunately there a lot of fans who don't see Batman as the way you describe him. As a matter of fact they look at the idea of Batman being a "psycho" and basically gawking at it. I think its just something thats totally foreign to them. They've grown up with things like the animated series (which is fine) and thats basically what has been encoded into their brains as what batman should be. For me I'm more in the same camp as you guys.
I haven't seen many Bale films, but he really didn't have that much charisma in TDK imop...I had to watch the film several times before I actually noticed that Bruce Wayne was even in the movie.
With Batman being a psycho; you failed to mentioned him his scene with lucious about the sonar system. "Beautiful..isn't it?" Bale's batman was pyschotic. But yeah, The hype of the joker may have over shadowed bales batman's lunacy. The interrogation room IMO still shows bats and joker at there finest.
I think one of the problems that I had with the batman character in this film personally, was that when I think of the type of atmosphere that the batman I want creates, I think of the tall muscled imposing demon that will overpower you with his presence. And when I was watching the film, and Batman came on to the scene, the thing I was thinking was, "... Wow, Bale is really short."

I don't see the Batman sympathy for Joker at all. In fact Joker is probably one of the few villains he really hates.
