I think its only illegal if you try to sell it.

But for private use I think its okay.

I've actually had a lot of local bands thank me for filming them because it helps get their name out there, and maybe people who wouldn't have otherwise heard of them might see their live shows and think they're good and want to go to their next gig.

Only illegal if you're looking to sell it. Concerts discourage the use of taping concerts due to people attempting this. But overall, no, not illegal to tape.
