Enrile backs PCSO fund mess probe

MANILA, Philippines - Senate President Juan Ponce Enrile yesterday said he is supporting a congressional inquiry into how the funds of the Philippine Charity Sweepstakes Office were used in the previous administration, particularly reports that some Catholic bishops received Mitsubishi Pajeros from the PCSO.

Enrile, however, reminded his fellow lawmakers against prejudging former President Gloria Macapagal-Arroyo over the reported misuse of PCSO funds during her term.

Senate Blue Ribbon committee chairman Teofisto Guingona III has scheduled the first hearing on Wednesday.

While Enrile said nobody should be above the law, he urged his colleagues to conduct a thorough investigation first before pinning immediate blame on the former president and some lawmakers who reportedly benefited from the PCSO.

"Is the PCSO directly under the Office of the President? We need to determine that or if the PCSO is an independent entity... Of course, the president may endorse sometimes but it is up to the board if they will allow (the president's) requests," he said.

Enrile said the members of the PCSO board could be equally liable if and when there were violations of the agency's charter since they approved the transactions.

"(The board) scrutinizes (requests), and they will have to decide if they will approve or deny them. We need to review if these are within the bounds of the law or not," he added.

Whether Arroyo, now Pampanga representative, or the bishops are guilty, Enrile said nobody is exempted from the law.

"The law does not give preference to anybody even if you are a preacher, religious minister or the head of a church, if you committed a violation of the law.... even the president is not immune from the operation of the law, especially criminal laws. No one is exempted from the operation of criminal laws in this country," he said.

If the funds or vehicles are given for charity purposes, Enrile said there is a need to determine how the funds were distributed.

"Okay, charity but who must act to provide that assistance and what kind of charity? All laws must be interpreted according to the Constitution," Enrile said.

Enrile also debunked rumors that the allegations stemmed from the Catholic Church's vehement objection to the Reproductive Health (RH) bill.

As for the other recipients, Enrile said, "They have to show that they used it for charity. We are dealing with public funds here."

Reports said bishops previously identified with the so-called "Malacañang diocese" could be among those who received the sports utility vehicles (SUVs) that the Arroyo administration supposedly financed using PCSO funds.

There were also reports that some lawmakers allied with Arroyo, including her son, Camarines Sur Rep. Diosdado "Dato" Arroyo, benefited millions from the PCSO funds.

PCSO chairperson Margarita Juico earlier revealed the agency's former board approved the grant of SUVs to Cotabato Archbishop Orlando Quevedo, Butuan Bishop Juan de Dios Pueblos, Msgr. Augusto Laban of Sorsogon, and Fr. Roger Lood of Iligan City.

Catholic Bishops Conference of the Philippines (CBCP) president Nereo Odchimar said he used to be labeled as a member of the "Malacañang diocese" because of his supposed "closeness" to Arroyo.

"Before, I was associated in the media that I'm close to PGMA (Arroyo)... That has to be qualified that I am close with GMA because protocol dictates that as the head of the diocese, whenever GMA with several government officials (are in Tandag, Surigao), if I am there, I'm also with them because we have common constituents," he said.

Odchimar also said that whenever he "lobbies" with Arroyo, he did it for his flock and not for personal use.

"What is wrong with lobbying for the cementing of the roads in the coastal towns? That's not benefiting the Catholics alone. That is benefiting everybody... But for my personal use, I never asked," he said.

Odchimar earlier said the Pajero scandal will be tackled in the 103rd Plenary Assembly of the CBCP on July 8.
