Course Description:
The Individuals with Disabilities Education Act ("IDEA") governs how states and public agencies provide early intervention, special education, and related services to children with disabilities. Join Professor Mary Noe in this CLE presentation that covers the IDEA and the situations in which children are eligible for tuition reimbursement. Ms. Noe goes over how qualified disabled children are entitled to Individualized Education Programs ("IEPs") by public schools that are created to identify the unique educational needs of that child in the Least Restrictive Environment ("LRE"). She then briefly reviews the content of the IEP, the various people involved, and the factors taken into consideration when constructing the programs. The majority of Ms. Noe's presentation discusses the the standards for determining tuition reimbursement for children who attend a non-approved private institution to fulfill their educational needs, with particular focus on the recent Supreme Court ruling in Forest Grove School District v. T.A.. She also explains to attorneys the requirements of the burdens of proof are and the can obtain attorneys' fees. Ms. Noe's expertise in this area of law will be helpful for all practitioners in education law as well as parents of special needs children.
