The usufruct is not the estate itself, nor the produce of the estate, but the right to use it and take the produce. Hence it is 'ius' a ‘right’, as opposed to corpus, a physical or corporeal thing. All usufruct does is establish a "right to fruit" not transfer possession nor "legal title" .... think apple tree.

Everyone who wishes to use the fruit of the tree does not own the tree, just the right of usufruct which entails the tree not be harmed; its substance must remain unaltered.
