A preview of the 5 week Study Group that constitutional law Prof. Jane Scarborough (Northeastern University) will present at Stonewall LLI on The Status of Gay Marriage in the Courts.
Jane identifies the issues at play in the recent California (Prop. 8) and Massachusetts (Judge Tauro) cases, both of which will likely be appealed and end up at the Supreme Court.

  • federal constitutional law has been consistent throughout the history of marriage ranging from plural marriage ( Murphy v. Ramsey), from interracial marriage (Loving v Virginia), to even same sex marriage (Baker v. Nelson) that marriage is between one man and one woman and the purpose of it is to PROMOTE procreation into a monogamous environment where there is two biological married parents. something same sex couples cannot do.

  • Unfortunately, we've had more years of legal Catch-22 as far as homosexuality, and it's slow in changing.
