  • It does strike me as strange that when it is possible to obtain free telephone advice from a specialist solicitor many people choose not to. As you have illustrated from your comments, this area of law is difficult to understand. By knowing what to do in any given situation simply increases the chance of winning.

  • Thank you for your kind words. Although it would be nice to win every case, I don't. That's impossible. What is important is that people obtain the correct advice for their individual circumstances (and not just copy a generic letter from an internet site).

  • In my view the police and the CPS try to 'bully' motorists into pleading guilty by threatening court. Your view of giving a 'best estimate' to the police and then everything will be ok is simplistic and naive. I'll leave the final word to my client who has just emailed a testimonial to me:

  • @normski262 Unfortunately the Freeman stance carries no weight when confronted by blue flashing lights, as many FMOTL will testify. Fee schedules & bits of paper will mean nothing when your vehicle is driven off to the pound, & no insurance, V5C, or driving licence will make it very difficult to recover.

    Those in the 13th century had no clue that metal boxes capable of 100mph would exist, legislation has evolved to encompass such changes.

  • Well sorry mate I thought road trafic ACT'S are act's given the weight of law by consent, what happens when we don't give consent ? Thats common law, which is above any acts of Parliment !

  • @lollygaggle On the part of the driver, who has heard something at the pub, on the internet or paid good money to one of the shysters who sell letters guaranteed to make any speeding allegation go away.

  • @jm5910 Scheme to dodge the points on which side?

  • @lollygaggle It is not legally binding, there is no requirement to send out multiple NIPs, but also no reason why they cannot be sent, and that is what used to happen. The reason it is not done now is because it is so often part of a scheme to dodge the points.

  • @jm5910 Take the easy route? It is the legally binding route - there is no requirement for multiple NIP's to be sent.
