This is a small class at a rochester LAW meeting explaining a nisi prius court. If you plan on doing any litigation you will need to know how to get a court of record and tell how you in fact have one. If you would like the whole lesson please go to http://rochesterlaw.org/store/ and go to the Video Lessons to obtain it.

  • Lets put it this way, singing reserving all rights or without prejudice does not hurt, but I do not put much stock in using the ucc. It is private law under copyright. We are much safer and better off using the administrative procedure to which similar terms can be applied.

  • Love this knowledge... How do you dis-regard the traffic ticket when your pulled over.. They always tell you to sign and that this is not an admittance of guilt but acknowledgement that you've received the ticket. What do you right on the ticket to object to being subject to a court of no-record??

  • When they ask you to sign it, ask them, "What will you do if I do not sign it?" or "Will I waive any of my rights by signing it?" The first question is, if they say they will arrest you, then you say you are signing it under duress and put that with you signature. If you ask the second question, of course you will be waiving rights so you inform the officer that he is forcing you to sign and sing under duress.

  • Very informative comaired to what I learned taking a paralegal course.

  • @sparktronic do you think signing without prejudice works?

  • Excellent overview of a "court of record" at law vs. a Nisi Prius Court (court by prior agreement - not a court of record).

Check out Bill Thornton's material too on: 1215 org

He has three detailed audio seminars - "Sovereignty", "Motions", and "Forms" - that covers one's standing as "one of the people" (a sovereign), establishing a "court of record" (capable of proceeding according to the course of the common law), and challenging juris-diction of the other party.

  • Thanks for sharing!
