Actually, James Madison said, "Beware the tyranny of the Majority". He meant that the rights of any minority in any society would not be protected by "the People" i.e. the Majority.

So, like I said, the rights of Blacks, Indians, Women, Gays, Midgets... you name it, must be protected by law, whether through the legislators or the courts.
