For seven years Dutch Prior has taken pride in being a truck driver. Last year, he signed on with a company called Shippers Transport Express. Although he drives their trucks, Shippers Transport calls Prior an independent contractor - not an employee.
"I'm not classified as an employee," Prior said. "I'm classified as an independent contractor, but I have very, very little control over the success or failure of my company."
Despite his so-called independence, Prior works exclusively for Shippers Transport, which doles out his daily routes. He has seen his paychecks dwindle, and he has none of the protections he would get as an employee.

They should'nt have talked to the ATA, American trucking Association represents the biig trucking companies & A Lot of the big shippers. not the drivers. they should have talked to the Owner-Operator, Independent drivers association (OOIDA). Dutch should have called OOIDA also they could have given him advice, informed him of any pending class action suits he could join, & they aren't afraid to take on the big shippers or the U.S. government on behalf of the drivers.

When I worked for Creative Computers they put our whole department on salary one day and told us that we had to work overtime whenever they told us to without overtime pay. I took the company to court, won the case but was treated badly for 2 more years when I was laid off on that day and replaced with an employee paid by another department. Now I I've been told the company moved the work to India.
