If the SCHP had consent from driver it would be legal. If SCHP saw something illegal in vehicle (plain view doctrine) or if SCHP had probable cause to search vehicle.

He stated he smelled alcohol. In South Carolina it is illegal to have an open container of alcohol in a vehicle or if you are under 21 to possess alcohol. So if he smelled alcohol (and was not lying) he could search driver and passenger areas. And if they were underage he could extend his search. Hope that helps.

What agencey is the other officer from? I can not believe he just stood there while the Trooper engaged in a foot pursuit alone at night. He needed to secure the other two occupants and then back up the trooper. Sad, very sad!! Oh and the comments the trooper made were deplorable...I mean come on, you are being recorded!!

I am not aware, at this time, which agency he is from. I may have responded differently, but I believe he may have not wanted to escalate the situation. He would have had to fight two subjects, alone, if they chose not to comply. So keeping them calm was probably the best thing to do, besides call for back up.

I will tell you right now, no matter what that young man did or does he does not deserve to be called nigger. But in turn he should not of ran, but that is no reason to use that word.

wsronmac! i used to live in ware shoals.alot of those officials are not so bad.i agree he shouldnt have run,nor the cop should have said what he said.but.the laurens county right there at the bridge will tell you to cross the bridge.than blue lights.watch it there!

The cop was very nice to begin with, I would like to know what was found in the car ? It was rude for him to call the guy a niger, but its a word that has been used for a hundred years+ by both blacks and whites to desribe the American black race. Even the bible uses the word in act 13. When the holy ghost calls upon a spirit who is familuar with the term,For forty yrs I had though the term cracker was to compare my skin to a saltine cracker,but found out it means a white beater with a whip,

Quite simply, the man should have shut his mouth and when the cop said he was going to search his vehicle the guys should have said no thank you. People MUST know their rights!!

wow... You and me both. If that was anyone in my Dept. we would be fired before we marked 10-42. We always have to be more professional than the criminal. Yea I've had my times. But ill never take myself down to there level.
