On November 30, 1945, the ninth day of the Trial, the prosecution called German General Erwin Lahousen as the first witness for the Prosecution. The Defense had not ben notified. After much discussion, Chief Justice Lawrence allowed the prosecution to proceed.
General Lahousen was one of the few survivors of the small German group which plotted an unsuccessful assassination of Hitler in July 1944. He was questioned by Colonel John Harlan Amen, French prosecutor Dubost and American judge Francis Biddle. He testified referring to a diary Admiral Wilhelm Canaris.
