Technically, the FISA argument made at 5:08 is incorrect. YOU DO NOT NEED TO SHOW PROBABLE CAUSE, you need to show a reasonable belief. The fourth amendment applies to CRIMINAL INVESTIGATIONS, not to matters of NATIONAL SECURITY. FISA warrants address matter of national security, therefore probable cause is not needed. The FISA courts jurisdiction was crafted this way so as to avoid 4th amendment violations.
