You're right, there is no way to tell. I have not seen the work of the other nominees, but I really did not think Heath Ledger was amazing beyond impressive. Heath Ledger is a good actor, and maybe if I were in the position of the decision makers I would seize this last opportunity to give Heath Ledger an award for his legacy. The bad thing is another actor probably got jipped.

you could be right, but really there's no way to know for sure. certainly i've seen much lesser-deserving performances of still-living actors get awarded , so it's not entirely out of the question that anything he wins is in fact based on merit!

yay, and he won!!! i'm happy for him, will get his career back on track. i haven't seen the movie yet, but now looking forward to catching his performance....

i agree. it was a very singular performance. one of the most haunting film performances i have ever seen, in fact, with or without the knowledge that he had recently passed on....

I think heath ledger extraordinary work in THE DARK KNIGHT deserves the nomination! Not for his dead but for his superlative interpretation!

Again, how would it be possible for you to have seen those films when they haven't opened in your country? You were saying "The Dark Knight is better than Benjamin Button" and now you're saying that you haven't even seen it and you claim you're not biased? I don't have a problem with any kind of film claiming the Oscar as long as it deserves it, The Dark Knight doesn't deserve an Oscar just because a bunch of fanboys are gonna flip if it doesn't get one.

Let's see, you're Australian, none of those films have opened there and I doubt someone your age has the connections to attend a private screening, so... there's no way you've seen them all.
If you knew about films, you would know that the real crime is Milk not getting nominated, The Dark Knight never had a chance for anything other than Supporting Actor and people are slowly starting to realize that.
