You would be right, except the entire text says: "A well regulated militia being necessary to the security of a free state, the right of the people to keep and bear arms shall not be infringed."

Militia: "A military force of civilians to supplement a regular army in an emergency."

The idea is that weapons be placed in the hands of ordinary citizens, in case they ever need to form a militia. A militia, in its simplest definition, is not an active body in times of peace and security.

the specific wording of the 8th amendment is "excessive bail shall not be required, nor excessive fines imposed, nor cruel and unusual punishments inflicted" - this does not explicitly prohibit capital punishment or life imprisonment, though of course its open to interpretation, hence the debate around capital punishment. however, the punishments that were in question & led to this amendment were things like public dissection, drawing & quartering & burning at the stake.

wrong. The second says they have the right to bear arms for a MILITIA. How many people now a days are part of a militia???? Everyone in the National Guard..... that's it. Anyone else does NOT have the right to bear arms as they are not a part of a "well-regulated militia."

If you ever get the chance to ask a politician about the 10 first amendments he won't know them all. He won't know the 2nd amendment for sure. And he will not know the 5th amendment to the 10th. It's possible he don't know any of them. I don't think that any politician that doesn't know the 27 amendments should be able to rule for a day in the United states of America/the land of the free/the land of the idiots/I generally hate you guys/But at least demand something from your government will ya?

The 5th to 8th amendments PROHIBITS TORTURE AND CAPITAL PUNISHMENT. Meaning that the right of the state to kill you for any crime you commit is against the 8th amendment. The punishments cannot in any way be degrading to the perpetrator. So Lifetime in prison is also illegal.

And 216 lifetimes is also illegal as it's ridiculous and impossible.

9th amendment is just more small rights for you.

10th amendment is that only those selected by people have the right to govern.
