One of The Register's regular readers sent this in: Publix Supermarkets has an office (we think it may be a print shoppe) at 2107 W. Lanier St. (e.g., at the Northwest corner of South Wabash Ave. & West Lanier St), in Lakeland, Fla. Now, this video is NOT meant to insult Publix, as they typically try to be good neighbours, but that may be the unintended effect:

It seems that one of their neighbours, James K. Kessler, who lives at a nearby unspecified address, is pictured in this video complaining about their apparent violation of the City of Lakeland noise ordinance, very late at night and into the wee hours of the morning, thereby preventing him from sleeping at night.

Since it is a matter of public record that Mr. Kessler has been arrested once for violation of said ordinance, for merely speaking too loudly, and warned several other times for playing his guitar too loud, this is proof of the existence of alleged noise ordinance.

The concern of The Register is that the Lakeland Police Department has a double standard, as they selectively enforce this local ordinance against citizens, but not against businesses:

This reporter has been to that location and can testify under oath that the business in question, while maybe not loud enough to offend this writer, is nonetheless typically louder than Mr. Kessler's speech under any circumstance, raising the spectre of a double standard and a violation of the State and Federal Equal protection clauses. This writer also has personal knowledge that Mr. Kessler has repeatedly reported this matter to the local police, without any action, implicating State and Federal Due Process and Redress violations and possible 43 USC 1983 Civil Rights violations of abuse of power under the colour of Law.

Since Mr. Kessler has asked this reporter for assistance in getting the word out about his grievance, then it is safe to say that this footage is being used with permission.

  • Long-story-short: Lakeland, Fla. Police appear to be engage in double standard regarding noise ordinance: Businesses allowed to be loud; Citizens not allowed same standard.
