On what grounds is UCMJ better equipped? A UCMJ means the US accepts the prisoners as soldiers which opens calls into question the American treatment of "POW" and requires investigations into waterboarding which itself is a warcrime punishable by death, you go down that root KSM will not be punished until those who waterboarded are.
Do you really think if AlQaida had the means they would not attack NY? they would attack today if they had the means regardless of a trial.
