Well I guess I better reply to this...

The updates contained on some games is because the software they designed the game with is not backwards compatible with previous xbox software, to be honest it is a bad choice on the developers part. Secondly, you can accept any EULA and if any information is taken you have legal ground to sue because EULA is unconstitutional, they make you agree to terms AFTER you purchase something.

Also your state sells your info all the time, focus your efforts on that
