Police Brutality: ANDERSON, Ind. (WISH) - An Anderson woman said she lost her faith in law enforcement after SWAT members damaged her home and left her homeless.

Mary Williams said being inside her house for much longer than a minute causes her eyes and throat to burn and her skin to itch. She said Anderson SWAT damaged her home even though she allowed them to search it for a wanted suspect.

Anderson police got a tip that an armed and dangerous man was hiding out in a downtown home. Police said they were looking for Tracy Miller, also known as Tracy McCloud. He is the son of Williams' boyfriend. He's also wanted for armed robbery and federal drug dealing charges.

"She said we can come in and look and then we found out there was a dog in there, which may put us in harms way. We said, 'Would you mind removing the dog?' She then came outside and said she didn't want to remove the dog," said Detective Mitch Carroll.

This is where Williams' story and the police story start to contradict.

Williams said she did remove the dog from the house and waited across the street. But it was another four hours before SWAT arrived and started shooting tear gas through the windows.

"Like how you see a movie, a Rambo movie. How Rambo hides in the woods. It was awful. You could see big lights going off," said Williams.

SWAT came out empty handed -- McCloud is still on the loose.

Meanwhile, Williams said she is now homeless. Nearly every window is broken from teargas canisters and gas grenades and the strong sting of chemicals still lingers in the air.

"Her claim is probably valid there but I think, over time, it is going to dissipate," said Carroll.

Carroll's explanation offers no consolation to Williams. She filed a complaint with the police department and wants her belongings replaced.

"You should not have to go through this, especially with people you trust to protect you," said Williams.

According to the city attorney, police are not liable for damage caused during a SWAT raid.

  • @redsmanager57 Never give consent to search your house or vehicle. If you give consent police are NOT 100% responsible for ANY damage to your property. But if you say no, they first need probable cause then obtain a warrant. And you are more likely to win a small claims case against them for damage to your property during the search. Always get information on EVERY cop who participated in the search or was present. Also depending on the state, you can ask for business cards.

Yes they are. especially a fruitless one. the fugitive wasn't even there! do they get to destroy your home because your 35 yr old stepson who doesnt even live there is wanted by the law?! They are 100% liable. the chief is just trying to cover their ass. they are banking on that woman being to poor to get a lawyer. i hope they have to buy her all new furniture, windows and bedding. seriously, why should she foot the bill?

    They didn't have a warrant, because they asked permission to search her house. That's called a permissive search based on probable cause, and she has the right to refuse.  The officers carry tasers and pepper spray, enough less than leathal equipment to subdue a K-9. Swat raided the wrong house, and as such, should be held responsible for damages caused during that raid.
