Two weeks ago, my house was sold at the Trustee Sale to an investor. His agent, Randy Duncan, informed me of the sale by serving me with a 5-day notice to vacate - the standard eviction notice here in Arizona. We agreed to a longer time period, about two weeks, so imagine my surprise when I received an Eviction Action seeking a $1600 judgement for back rent! Distributed by Tubemogul.

  • [2] Get a 2nd bank account for doing grocery's and other spendings. Withdraw from the first account and deposit it on the 2nd bank account.

    So that, you can not use the money that was intended for the important bills. In that way all your important bills will be paid, instead of you overspending.

    Work your bum off on your debt, cut in luxury spendings where you can.

    And start now, before disaster strikes your family.

    Be Calvinistic, enjoy life.

    I am speaking in general now, not to this nice lady.

    Cut your credit card in two. Make an overview off all your costs and income.

    Get rid of your debt, get savings.

    And save, if you want to buy something new. Be mature.

    Try to save at least 10% of your income.

    Get a normal bank account on which you can't borrow, and let all your important bills get withdrawn from that. Like mortgage, electricity etc.Let your boss deposit your salary on that.

  • This is why some people are smashing the living shit out of everything in their foreclosed homes, stripping out all the fixtures and wirings so these bastards end up with a useless property.  I don't approve of that behavior, but if these investors would learn to handle the situation better, it might not happen as often.

  • You seem like a smart person, I do feel for you. As long as you/anyone isnt trying to get free rent or, like some of these videos show, destroy out of spite I cant see why a new buyer & an old tenant cant come to an agreement.

    I just watched a video where the bank paid a forclosed person who stayed without paying 3 months $2400 to leave the place by a certain date & in good condition.

    I hope to buy a foreclosure some day. After seeing these stories I would do everything to protect myself

  • Well if you are still in foreclosure just make them produce the note.Note being the contract you signed with the bank.You dont want a copy of your contract they need to show the original "Wet Ink Contract" Not to mention they must show the contract and the deed at the same time to show possession of ownership.And its 90% chance they cant do it because the note was sold on the market.Even if you are out of the house now,go file suit against the bank and get it back.

  • He sounds like an A-hole to me. Maybe one day he will lose everything and get a taste of his own medicine. One can hope anyways.

  • Maybe you should just use the legal process to delay and stay there as long as possible. Maybe if you get some victory in court he will decide to negotiate something reasonable with you.

  • Despite the bail out some people are getting absolutely nowhere negociating with the banks. What has happened with those adjustable interest mortgages is absoutely criminal. If I was someone in that situation I could understand why they would trash the place rather than have the banks or anyone else profit from their misery. The whole thing makes me angry to be honest.
