Internatational collision regs state that all Vessels should avoid collision at all cost. Even though the ferry had right of way, it should have taken evasive action.

The skiff could have croosed the ferry but the skipper lost his nerve.
The ferry had right of way.
There was really nothing he ferry skipper could do but hope the skiff sailors didn't drown.
