Question 1: I have clients who are undergoing a messy and acrimonious divorce. Apart from having joint assets, they also have a company and family trust assets that they are look at trying to split.

What are the Duty and Capital Gains Tax (CGT) implications of the transfer of assets between partners?

Question 2: I have a Self Managed Superannuation Fund (SMSF) and am looking at buying the commercial premises from which my son operates his Gym and Fitness Centre as an investment.

What are the rules on acquiring business property in your SMSF and can my son lease the commercial premises owned by my SMSF?
