The President's health care law does not, as it turns out, empower the IRS to punish employers for failing to provide workers with government-approved health insurance when the state in question has refused to create its own state-based health insurance exchange. The IRS, however, is moving ahead without Congressional authorization. Jonathan Adler, a professor of law at Case Western Reserve University, offers his thoughts.

Which is why I assume I will be losing my excellent health care package in the next 12-24 months. Our employees voted to forego pay rises and instead allow our company to use the wage freezes to pay for the company health care plan, an excellent plan. Now that the penalty will only be $2500, which is VASTLY LESS than what the per individual cost of our company plan is, we will be dropped and shoved onto the government exchange. 1) Worse health care plan, 2) Years of wasting pay rises
