@friedchicken187 The provision that you refer to in the NDAA Act was enacted during the Bush administration, albeit in different language. With 9/11 a new type of warfare and combatant must be addressed by our American government. The wording in this provision will always be up for debate. How it is applied will not. Bottom line after all the overstatement of facts is. No Federal Statute Can Repeal The Bill Of Rights.
