CPS wrongful removal of Baby

CPS in Texas filed an affidavit with the courts stating, "Baby's mom was positive for illegal drugs." CPS said the house was unclean and unfit for the baby.
CPS LIED! For once, their lies did not work.
Drug test - NEGATIVE
Condition of House - Judge wanted to know why this statement was in the affidavit if known to be untrue.
Quote from transcripts:
Judge: I'm not cutting anybody off [...]but you have in the Affidavit [of Facts] that the house was dirty and there was dog stuff on the floor.

CPS: That's what it had alleged in the report, yes, sir.

Judge: Tell me about that.

CPS: The condition of the house was appropriate.

Judge: I'm sorry?

CPS: The condition at the home was appropriate for the child.

In seven weeks infant was in foster care she came home with a severe sunburn, diaper rash with pustules, asthma requiring breathing treatments throughout the day!

This baby is so fortunate to have a mother and father who love her dearly, and a grandmother you do not want to mess with!

  • I hate cps if someone calls on you that will take your kids away how can you live with yourself destroying familes and watching the tears run down there face as you drag them in to the car to take them away I was taking away from my mom and dad when I was 8 because of the nieghborhood I lived in at the time then I stayed in a foster home and I was soo scared and it was a huge mestake I went back 2 weeks later and the judge ordered the cps worker be fired

  • @kylak8j I have entered numerous foster care institutions and I know that had the child's home looked as bad as the state paid placements, the caseworker would have removed the child for unsafe and unsanitary living conditions. Take the same child and put them in foster care and the sky is the limit on how bad the placement may be.

  • my child's diaper rash got worse when he was taken from my home & put into a shelter also. i'm still looking for solutions to our social services problems. the power of the people doesn't seem to remain as powerful as it should, unfortunately.

  • If you have documented each and every incident and completed the services required by the courts, if your child suffers in foster care, try to find an attorney who will file suit against Texas.

  • Thanks for showing some good and negative points about CPS. I feel that case workers need more support and education in the area of Child Abuse Preventioin themselves. Most caseworkers are so overwhelmed with heavy caseloads, court appointments, and home visits that its causes stress and they are unable to think logically.Supervisors are inexperienced and caseworkers are inexperience. Child Abuse Prevention and Community Involvment is the Key.

  • @HelpingCPSParents The organization, Child Abuse Prevention, has little to do with actual Prevention. Look at the stats; what have they done that is useful; where is the community support for parents? Prevention and in Texas, family reunification occurs in over 90% of some counties and in others, less than 2%.   • What is wrong with CPS!? This is the perfect reason they need to shape up or shut down. It was obvious that the baby was sick and foster care refused to take her to a doctor even though she was willing to pay any money it would take to help her. Then the "Loving" foster parents they give the baby to refused too! SERIOUSLY!

  • That being said, there should be more emphasis on helping women to overcome their issues,rather than focusing on taking away the children. There are underutilized facilities that treat women in-house, which allow them to keep their children with them while they are there. This is more effective long-term, as these programs also educate women with regard to budgeting, emotional intelligence, and provide them with a support system.It also allows them to continue to bond with their child.

  • @satanicangel21 The only difference I have personally witnessed is that this family writes letters for every single visit, phone call, or issue. Regardless what the problem, this family is on top of the issue and writes letters to rectify the problems. The letters become evidence and eventually, this judge saw that CPS was pulling rank on a family who did not need CPS involvement. CPS began to send different CPS workers, who claimed ignorance because they were new to the case.
