Also I was saying that just because something happens over and over again doesn't make it true. It makes it likely to happen again but we can never be certain. And for it to be a fact it must be completely true.

It's a theory because science never makes ultimate claims for itself, a scientist makes observations, comes to a conclusion, and he humbly presents it as a theory, because science is free thinking in another word, it might be disproved at some point later on, but thus far, no such "luck". :-)
