70 year old store clerk takes gun away from robbery and shoots at him 5 times

this store is by my home and i have been in there 100's of times
The 70-year-old clerk, who is a Vietnam veteran, repeatedly told the armed intruder — whom police identified as David Michael Malinowski of Argentine Township — to "get on the floor."
"Get down on the ground! Get down on the (expletive) ground like I told you to!" the clerk shouts excitedly. "I've killed people before; you think this is going to bother me? I'll take your leg out and I'll kill you."
Fred the clerk said he shot "full of bullet holes" in an effort to stop the robber.
Fred knocked the robber's weapon —which turned out to be a starter pistol — away, pulled out a handgun and ordered the would-be robber to hit the ground.
On the tape, Fred repeatedly orders the robber to get on the ground and tells him multiple times that he is not afraid to shoot the man dead.
The sound of four pops can be heard on the tape — presumably the gunshots.
"I just fired five shots. I fired five shots into his car," Fred said.
Fred goes on to say, "I was only forced to use my gun when he had a gun on me. He tried to grab my gun. ... I just took his car out. I didn't want to kill him."
Prosecutor David Morse said he will not bring charges against the store clerk.
"Under the law, you have the right of self-defense, and you may use that level of force that you are being met with," the prosecutor said. "If someone is pointing a gun, then you can use a gun to defend yourself. If someone is coming at you with a rake, you can't fire a gun."

I think Prosecutor David Morse does not understand the law of self defense... A person with a rake can kill you just the same as a person with a gun. It just might take longer... What commie state/city do you live in where a prosecutor would say something like that?
