You were involved in an accident at an intersection. You say you had the green light. The other driver says he had the green light. A witness says you had the green light.
The police officer writing the report wasn't there to witness the accident. He does however record what he sees after the accident.
The cop also talks to the witnesses at the scene; one of whom says you had the green light. The policeman writes in his report that the other driver was careless and caused the accident by going through a red light.
Can you use the report to show conclusively that the other driver was responsible for your accident?
Did the witness have a legal obligation to inform the policeman about what happened? The answers to these questions all affect whether you will be able to introduce that police report into evidence at the time of trial.
