@Weapon01 That's correct. He was using the phone not only to call for help, but to build his legal defense. That's very important. Living in a "castle doctrine" state is a great asset, but don't assume that those laws give you the "right" to just shoot someone. You never know what will happen in a courtroom. It is best not to ever have to be in that situation! Another thing about this phone tactic is that it may scare the invader away. Why get into a battle if you don't have to?

Keep telling yourself that. Get caught dumping a body and you'll find out exactly how well those non-existent laws apply to you regardless of your fantasy that they don't.

If you live in a "castle doctrine" state, and Pennsylvania has an extremely strong castle doctrine statute (it does not require a homeowner/renter to retreat before shooting), you need merely explain your actions to the police, not defend them in court.

@ForTheDefense76 Why take time from my day, miss work, and time with my family to go to court and defend my actions about killing some shitbag that entered my home, and endangered my family. For me there is only one thing to do. Yep throw them in the trash with the rest of the garbage. You see "For The Defense" I play by different rules, than most folks, for me, there are not laws. Eye for an eye. There are lots of people like me in the world, one thing we are not, and that is a victim.

A blatant attempt at dodging my question, but an all too obvious dodge. So, once more: WHY "DITCH" THE BODY OF SOMEBODY YOU'VE LEGALLY SHOT? IT CREATES A SITUATION IN WHICH YOU CAN BE CONVICTED OF MURDER OVER A PERFECTLY LAWFUL KILLING.

You are thinking "Should I shoot this stranger, Hope I don't kill him, I don't want to go to jail" while I'm thinking "This stranger entered my home, they will in fact die, I'm not going to jail over this scumbag". My little story? Melodrama? Really, I'm not sure where your from, but here in Pittsburgh PA, its very real, then again, its getting bad everywhere these days.

My suggested title was "How To Turn A Justifiable Self-Defense Homicide Into A 1st Degree Murder Charge In 4 Retarded Steps." A more precise title would be "How To Turn A Justifiable Self-Defense Homicide Into A 1st Degree Murder Charge In 1 Retarded Step." Specifically, step 4: "Ditch the body."
Why "ditch" the body of somebody you've legally shot? It creates a situation in which you can be convicted of murder over a perfectly lawful killing.

Nonetheless, I simply shall not allow you to misstate my position and then pillory me based upon that misstated position. My suggested title makes clear that I have ZERO issue with killing an intruder.

So yes, break in to my home, cause a threat to my loved ones, your dead plain and simple.
