Drew Zahn, writing for WorldNetDaily, takes issue with Infowars declaring Obamas national emergency amounts to martial law. An article by Kurt Nimmo of InfoWars took the worry a step further, wondering if the White Houses declaration engaged certain measures of the National Emergencies Act, writes Zahn. But even if there really is a plot to manipulate the H1N1 virus scare into enforcing a sweeping expansion of federal power, todays national emergency falls far short of martial law.

A state of emergency (regardless of the pretext) allows Obama to do a number of things. As Dr. Harold C. Relyea, a specialist in national government with the Congressional Research Service (CRS) of the Library of Congress, has written, when the President formally declares a national emergency, he may seize property, organize and control the means of production, seize commodities, assign military forces abroad, institute martial law, seize and control all transportation and communication, regulate the operation of private enterprise, restrict travel, and, in a variety of ways, control the lives of United States citizens.

Obamas declaration, however, is incidental because the United States has been under a state of emergency since September 14, 2001. Bush extended this emergency (against a bogus terrorist threat) on August 28, 2008.

Will President Obama allow the state of national emergency, first declared by President George W. Bush on 9/14/01 and re-declared seven times, to remain in effect? asked Peter Dale Scott and Dan Hamburg on February 10, 2009.

On September 10 of this year, Obama reinstituted the national State of Emergency.

  • I do not believe in Alex Jones. He is a liar if I did not support reform to universal health insurance. all it says is a lie. Where is freedom when no ahy health. Where is.   • You and Matt are. The information you post is from anit-vax sites and does not differentiate between vaccines in general and H1N1 in particular.

    The fact is that the H1N1 vaccine is based on the same science as the seasonal flu and was tested on humans as any flu vaccine is. Yes, H1N1 is part of the family of flus and next year it will be part of our seasonal flu vaccine program and hopefully, this idiocy will cease.

  • And frankly, a couple of the items are wrong. We have a fairly good understanding of the placebo affect and the Big Bang theory adequately predicts a homogeneous universe.

  • I'm fairly science literate. You wrote "Science cannot prove", which is wrong and is NOT what the article you cited is saying. It is saying that there are observations in this great big, wonderful universe that, at this time, science may not fully understand. It DOES NOT say that science cannot or will never understand them.

  • Ok, I wasn't going to post again, but this has to be addressed, not that it will do any good.

    Homeopathic medicine is water or in the case of pills, sugar. There is NO EVIDENCE that supports homeopathic claims. This is even more vile than anti-vax claims. People who take homeopathic 'remedies' at the exclusion of real medicine will die.

    I don't disrespect 'the first doctors'. They based their medicine on what past for medical knowlege at their time.

When troubles come science and your government won't help you. Only God can help people. You are free to believe otherwise. You still didn't answer my question: "Can I have a"freedom of choice" about vaccine"? Are you so "over-educated" that can't answer for a simple question? How's your family after shots?
  • Homeopathy is NOT make believe. Many people have had great results with it. You were sent an article on proof of homeopathy that is unexplainable as well as thousands of other cases where traditional medicine did not work. You have a lack of respect for the first doctors that existed and the now practicing doctors would not be where they are if not for the first real herbalist and primitive Doctors from different cultures.
