The US and and the Allies didn't take much time and effort for Tokyo War Crimes Trials and simply copied concepts and crime definitions from Nuremberg Trials. Nuremberg Trials were for Nazi German crimes in Europe not suitable for Jap crimes in Asia.
It's like putting the clothes specifically made for someone else onto you. That's why so many Jap war criminals including Hirohito could escape from hanging by the sloppy Tokyo trials. That's why non-Jap Asians don't like the trials.

At the beggining, Allied poweres planned to accuse Japanese war criminals accused for A) Crimees against Peace, B) Conventional war crimes, and C) Crimees against Humanity, in the same style of Nurnberg.
But through investigation, they awared that Japan did not commit enormous holocaust like as Nazis. That was why they have abandoned to apply "Crime against Humanity" for Japanese.
