THE ESSENTIAL SHORT REFERENCE WORK FOR ALL INVOLVED IN CRIMINAL INJURY COMPENSATION CLAIMS
An appreciation by Phillip Taylor MBE and Elizabeth Taylor of Richmond Green Chambers
If you are a practitioner tasked with advising a victim of a crime of violence, this handbook is essential and welcome source of information and guidance in this sensitive and fraught area of law. In particular, it's directly relevant to those seeking claims for compensation received after 3 November 2008 which are covered under the Criminal Injuries Compensation Scheme 2008.
Under the scheme, a number of important changes to the appeals process have been put in place, i.e since the previous edition of Criminal Injuries Compensation Claims was published in 2005. The First-tier Tribunal (Criminal injuries Compensation) for example, has replaced the Criminal Injuries Appeals Panel.
As pointed out in the Foreword by Tony Summers '...all appeals including those under the earlier Schemes are now subject to the Tribunal Procedure (First-tier Tribunal (Social Entitlement Chamber) Rules 2008.' This book is essential for familiarizing practitioners with the new formality now inherent in the appeals process and with the Rules for appeal hearings and other important changes to the appeals process which need to be considered by all parties.
The book functions as a supplement to the 2005 Criminal Injuries and Compensations Claims by Clare Padley and Laura Begley (which contains a more detailed analysis of criminal injuries compensation claims generally.) It is vital to refer to both volumes to achieve best results under the new Scheme.
Scholarly, authoritative and up to date as of April 2010, the book also contains copious appendices which include: the fully detailed Criminal Injuries Compensation Schemes (2008)...a Guide to the Criminal Injuries Compensation Schemes (2008)...and usefully, the Tribunal Procedure (First Tier Tribunal (Social Entitlement Chamber) Rules 2008. Yes, it is essential reference for all parties involved in criminal injury compensation claims.
