The blame for that is shared genius, Clinton gets blamed for erecting a legal wall between the CIA/FBI and treating Ideologues at war with us like common criminals-That mistake is now being repeated by Obama.. Bush removed that wall w/Patriot Act and created an apparatus at Gitmo to deal with these ghouls. The 911Commission Report outlines the breakdowns and culpabilities of Both administrations. 9/11 was plan financed and the Jihadis were training for it prior to Bush's election.

AS Illegal enemy combatants, they arent entitled to any constitutional rights. They dont even qualify under the Geneva Convention. They have no uniform, flag, or country, hence the term "Illegal Combatant". The apparatus of military tribunal was designed for this. FDR used it and summary executions. As far as the facility itself, it's a countryclub compared to the others like it around the world. Gitmo houses the most dangerous men on the planet(Islamist Jihadis).
