  • Case settled: Banks will pay $316 million each cash, almost two-thirds less than $4.6 billion in damages sought by Huntsman who also wanted billions more in punitive damages.

    In opening arguments, the solvency opinion got compared to a termite certificate on a house by Richard Clary, a lawyer for the banks. Imagine you are the banks lending on a house and the buyer says there are termites and you can see them, but the seller comes and gives a certificate of no termites.
