Protesting N.Y. Terror Trials

Hundreds rallied in NYC to protest the government's plans to hold major terrorism trials in a Manhattan federal courthouse. As Randall Pinkston reports, the courthouse is just blocks from ground zero.

KSM not an enemy combatant??? Good lord, man, where do you come up with this stuff? Of course KSM is an enemy combatant and military tribunals are exactly where these pieces of sludge need to be tried, not in a federal court where they may have access to classified documents and where they are free to spew their anti-american bile. Enemy combatants are people the U.S. regards as unlawful combatants that don't qualify for POW status. KSM and his bunch definitely fit that catagory.

I wouldn't practice vigilantism. KSM is not an enemy combatant by our own definition. Use of these tribunals are for enemy combatants who violate the rules of war. All detainees should be tried in a federal court, since there was no declaration of war-as the constitution demands. Again, letter of Marque and Reprisal were never issued against specific terrorist or even an organization! Instead, we let OBL go into pakistan and started a nation building mission-something bush campaigned against!

I'll ask you again, if you personally were attacked, would you fight back or wait and ask some authority figure if it was okay for you to fight back? You're right, Afghanistan and Iraq didn't declare war on the United States, but the terrorists organizations in those two countries did when they flew airplanes into the pentagon and world trade center. Bush had to act quickly and decisively.

So we throw the constitution out the window? The President absolutely has to ask for a declaration of war! We should have issued letters of Marque and Reprisal against specific terrorist. How can you have a war on a tactic? Of course it wasn't lawful, this doesn't mean Iraq or Afghanistan declared war on us.

VictoryCough, Bush didn't have to ask congress for a declaration of war, war came to us and we responded. Would you personally allow someone to attack you and not fight back? I doubt it. The only thing you've said in this little exchange that I agree with is "terrorists are stateless individuals", that's why Bush called it "The Global War on Terror". You talk about a lawfully declared war. Was if lawful when these terrorists attacked us on September 11, 2001?

Terrorist are stateless individuals. The Framers were very clear on this issue and thats why Marque and Reprisal was included in the constitution, to target specific terrorist. McVeigh was a terrorist and is a perfect analogy- a stateless terrorist. After 9-11 Bush didn't ask congress for a declaration of war! War powers only apply during a lawfully declared war and one of those powers is use of military tribunals against foreigners! We are unsafe because we are over there!

Did Timothy McVeigh "declare war" on the US on behalf of white supremacists? Al-Qaeda made a constitutional decision for the US Congress and declared war for us huh? We declared war on Germany, Japan and Italy after individuals representing the gov of Japan attacked us. You're logic lacks sense, if you want to go to war you don't go to war under pressure from the UN or the president, Congress must declare war against a specific nation.
