Another whinge about copyright and how completely buggering inept YouTube are at trying to enforce the law. In this video, one of my works is false-flagged as being owned by someone else and despite the performance being my own and my face is in it, I have to dispute the claim.

  • I know it's a hassle but if Youtube hadn't established 'safe haven' they would've closed down years ago. I don't blame youtube, I blame the 96 out of 100 users who ignore the rights of others and the explicit terms of use - it's those dickheads who seem to think that Youtube exists soley for them to be pretend dj's and upload their fav music vid. again and again.

    Any who, that's my 2 bobs worth, good luck with with your false flagging issue , hopefully it'll get sorted sooner than later.

  • I've had the exact same problem, and it really makes me mad.  Same people as you mentioned. They seem to have made a business out of claiming the rights to other people's music. YouTube then puts ads on those vids, and those people make the money from it, until the rightful owners put in a dispute. Many people don't dispute, and the lying thieving bastards make all the money.

  • Copyright rocks if you're making a buck, or even just scratching the self-reassurance itch- but these random third-party groups that act as copyright protector without due diligence is a curse. In theory it could keep the small artist from being ripped off, but theory often diverges from real life...

  • Btw, this exact problem is going to be a topic of one of my final oral exams. And the irony of it all is, my sister works for this copyrights organisation. ;) But yes, I know, youtube is mostly to blame. ;)

  • I watched this & immediately had to think of our copyrights situation in Germany. It's pretty messed up; besides that any big labelled music (mostly from the US) cannot be legally viewed here at all, our national performance rights organization (GEMA) also uses the so called reversal of the burden of proof, anywhere, anytime. It just automatically claims a performance' copyright for itself, especially on youtube, although sometimes it doesn't make sense. Then absurd things like this happen.

  • Any partner that uses copyrighted material without licence will probably have their partnership removed. I know a few partners who perform copyrighted material, but they are paying the copyright holder. As a partner myself, I know that we are always being badgered about copyright.

  • Although you created the music on the video it may be the case that it sounds the same as another piece of music. This happens a lot, and the google copyright algorithms will identify such similarities. A court may find little similarity, but to get to that stage would be stupidly expensive. In the real world the resolution lies in the hands of the putative copyright "owner". If they are unreasonable your only realistic option is to remove the video. Copyright is FUBAR!

  • One instance in which something like this really pissed me off was a while ago, when I was searching for a music video to a Flaming Lips song. I went to their own official channel - maintained by the band themselves! - and the video had been TAKEN DOWN because of COPYRIGHT INFRINGEMENT and posted instead to their record label's VEVO channel. It just doesn't make sense, and there's no way it can be fixed unless the whole system is ripped out and started over with.
