Bank of America recently announced a halt to foreclosures in all fifty states, including non-judicial states like Arizona where the foreclosure process happens on the courthouse steps. The lack of court oversight when a bank takes back a house on a non-performing does not mean that the same mistakes that are happening due to poor practices by banks in court-supervised foreclosures are not happening in the fast-paced Trustee Sale process.
Despite the increased litigation that seems to be creeping into real estate transactions, the inevitable loss of your home when you fall behind the mortgage still remains a reality. Make sure you protect yourself with proper representation - it has never been more important.
Without foreclosures banks will just pass more of the costs of doing business so those who cannot pay a mortgage will benefit from socialism in the housing sector. No free checking? Higher ATM fees? Maintence fees? Banks are businesses. Socialism never works.

I'm glad my bank did it fast as they did. I need it completed by end of 2012 before the Federal Mortgage Forgiveness act expires and that I can now start re-building my credit. The longer the lack of payment lingers for my home, the longer it will take to start rebuilding my credit.
