Detained for Open Carry, Portland, Maine 26MAY2012

I was detained by Portland PD officer J McDonald on 26MAY2012. He detains me without suspicion of any criminal activity in violation of Delaware v Prouse. He admits his sole reason for stopping me is my legally carried firearm in violation of US v DeBerry. He seizes my weapon with no reasonable suspicion that I've committed a crime in violation of Terry v Ohio. He demands my ID without reasonable suspicion in violation of Hiibel v Nevada.

This guy was right, all of his court references were correct and he was within his rights to carry a weapon openly in Maine.

That being said, he's still a pretentious prick who was obviously doing this just to get a cop to stop him so he could film it and make himself look smart.

Open Carry w/o a permit is a crime in most states. Can't say about Oregon. Open and Concealed Carry w/ a permit = Legal. Citizen or officer sees open carry, that is enough to request permit. See gun. Ask for permit. Refuse to provide is obstruction. Taking gun away during investigative detention is legal, but once ARS dispelled, gun must be returned. Officer was corrrect, he just did not know how to explain himself effectively.

I hear what you are saying, however I think that the amount of homicides and gun related deaths within the United States is far more complicated then the number of weapons and the gun laws that are found here.Our culture, poverty, education issues, and mental health problems are all contributing factors. I live in Chicago for example, and it's pretty rare to see a gun related homicide in a wealthy community that has the same gun laws as a impoverishment community that sees far more gun violence.

You also obviously do not understand that inalienable, or in this situation, inalienable human rights pertains to a right that ALL humans are entitled to. We in the US have a murder rate from gun related homicides 20x that of 30 developed countries. First of all, do you not understand the correct usage of single and double quotation marks? Obviously not. Also, you do definitely do not understand that right is a simpler synonym for privilege. You would understand this if you actually knew what you were talking about or took 2 seconds to look it up as any other child can do.

Do you not understand the difference between a 'right' and a 'privilege'? We do not GET our rights from the constitution or the Bill of Rights! Do you understand the definition of inalienable?

I was never debating his right to bear arms or challenging it any way as you can see when I said I COMPLETELY UNDERSTAND IT IS WELL WITHIN YOUR RIGHTS. Cherry picking may be my thing but at least I don't completely make up ideas and thoughts to challenge.
