Since the first court decision to articulate Native American law back in 1823, our nation's courts have repeatedly invoked historical "facts" as a basis for fashioning judicial doctrines that have been prejudicial and harmful to Native Americans. This important symposium reveals that many of our modern Native law doctrines are based in fiction, not fact. Join us as we explore the historical foundations of key court decisions impacting Native Americans.

".....From blood to DNA, from "tribe" to "race" in tribal citizenship
This talk will compare symbolic blood as it has been used in 20th and 21st-century U.S. tribal enrollment with the more recent advent of DNA testing for enrollment. I briefly examine both "Indian blood" and "tribe-specific blood" and compare these concepts with that of the "DNA profile" that is increasingly used in enrollment in concert with existing blood rules. How might DNA testing influence how we understand "Native American" as a racial category? I argue that genetic practices are more likely to "racialize" Native American citizenship than are current blood rules alone, and this is more harmful to tribal sovereignty than are blood concepts of identity."

  • Why Do African Americans, want to have that Native american tie so bad? Can't you just be Black and be Proud of your blood? Why is that not enough? I Dont care what race you mixed with, if your native,, after 1/4 your not an indian no more because your family decided to mix and not keep the native blood going!!! Full, Half, Quater, Non Native!!! and I highly doubt that the majority of the blacks and whites claiming to haveNative ties have any at all! I grew up on my rez. & hate culture thifes!

  • @LaSexyNativa Hey, the same reason as you with obvious European ancesty have to pretend that you are more than you are to make people feel uncomfortable. People with signifigant Native Ancestry don't feel threatend by people of other races and cultures claiming part of their other heritage. What scares some people is that in 10 years DNA testing is coming to the reservation and people once denied their heritage will get to share in it while others that piggybacked might have to leave.

  • @MrEnemy57 Hey, good guess but not African American lol sorry. You shouldn't generalize though. I said over here which I happen to live and I didn't assume you did or didn't but that's neither here nor there. I can tell you from my experiences that I don't get too offended easily because most of the time people are just trying to figure out stuff so I try to listen. I'm not always right but I awlways try to listen.

  • @MrEnemy57 Hey, i don't really know. I've heard people say half human half mule but I don't know which one is the mule. It's says Black and White in the dictionary. They say alot of things over here and get very offended when someone else says stuff lol.

  • @TheMidnightBell07 Mulatto is a derogatory term here in the states. Not so much in Latin america. People don't mind using that word. "Mula" means mule in spanish. I belive is a hybrid of a donkey and a horse correct me if im wrong. I think that's what it means.

  • @MrEnemy57 Hey, I don't mean to be offensive it's just that Mexicans are the only Hispanics or Latinos besides Dominicans that don't claim race. Purteo Ricans, Cubans, and other groups claim admixtures but those two groups claim ethnicity. I agree with you that they are mixed but they don't like the grouping. I liked saying biracial rather than have mule lol. I just read the part about Dominicans so you notice it too a little. I don't mind what people claim I just want to understand it better.

  • @TheMidnightBell07 Why is this about mexicans? I think you mean latin americans in general. The vast majority of mexicans are mixed in varying degrees of admixture. not just 25% NA. Would you consider a mulatto person from the dominican republic as a black person??? Answer... NO. I'm sure they won't like it at all when you refer to them as black. They will go on a protest rally if you did. They are mixed. Simple as that..

  • @MrEnemy57 Hey, I know that's what I'm saying. Hispanics and Middle Easterners are the only people that go by ethnicity. When they do claim a race it's usually White or Black. I was told that the majority of Mexicans are in fact at least 25 % Native American. If you are White and have 25 % Native american you can registar as such but Mexicans claim non race. People feel more comfortable as mono raced even though they are mixed so they say just the one even though it's obvious they are 2 or more.

  • @TheMidnightBell07 that makes no sence at all..The person should identify himself as a mixed race person. instead of identifying as black or white. People of mixed race background tend to show mixed race phenotypes alot. Latin americans in general don't value race much. Latinos tend to be very nationalistic. Race is not talked about much in latino society...

  • @MrEnemy57 Hey, I agree with you; infact thery are more prevalent then on the census. There are three factors. One, convience. Some people are Natives with mixtures and their mixtures take center stage. I know a couple of people with a White parent and a Native parent and they call themselves White. I know some Black people of mixed Native and Black heritage that only identify with Black. People make the Native feel out of place. Mexicans can claim it because they don't have an interference race

  • @TheMidnightBell07 They are not extinct, they are just assimilated. Native ancestry in Latin America flourishes. whereas here in america, Native ancestry is almost something special. People love claiming amerindian ancestry here in the states. Its almost Like a mythical thing or something...
