This work of art doesn't make any infringe. There are an artistic tendency which is called "appropriation art" that consists of adapting old art by moving to our days. You could see them, for example, in some Duchamp works ( the potty or the Gioconda) in order to make a reflexion about the art limit. This kind of art isn't my cup of tea ( I don't love it), but there are a lot of artists that have worked in this way and they have got a big career.

Esta OBRA DE ARTE no comete ninguna infracción. Hay una tendencia artística que se llama "apropiacionismo" que consiste en adaptar arte del pasado y transportarlo a la actualidad. Sino les incito a que vean las obras del orinal de Duchamp o de la mona lisa y reflexionen acerca de los límites del arte. No és que especialmente me guste el apropiacionismo, pero son muchos artistas los que han recurrido a él como plataforma de expresión artística y han cosechado grandes éxitos.

actually charlie parker copied much of his work, in different keys from other sax players. That's how he got popular. Many classical pianists like beethoven copied other greats and were actively encouraged too. In fact, many classical pieces are copies or very similar to others. That is HOW people learn and create anew. We listen, we copy, we reproduce, we see, we copy, we reproduce. NOT A CRIME.
