He's not an atheist. he defines himself as an agnostic. However, you can be an atheist agnostic... or a theist agnostic.

@SuperAngryHippo The movie consisted of him asking questions. The answers were what was ridiculous. If that is offensive to the religious, perhaps they should examine what they believe.

Sure, if you redefine words, anyone can be anything. But the general definition of atheism is the lack of belief in a god or gods, NOT a belief that there is no god. An atheist has not been presented with convincing evidence of any such being, and thus can find no reason to believe it exists. In that sense, I am an atheist, and similarly an 'aunicornist' and 'aleprechaunist'.
This is exactly how Maher describes himself, so yes, he is an atheist.
