  • Hello i had a question .. i am making a "preventing sexual harassment" training program for a project in university and i was wondering if i would be able to put the link to this video in my project? i would cite the video and everything?

  • Yes, feel free to use this clip. Good luck with your project.

  • What if you're a dude, and some other guy tries to grab your junk?

  • If you're a dude and another guy tries to grab "your junk", it could still be considered sexual harassment. I say "could be" not because it's same-sex sexual harassment (which the US Supreme Court ruled is prohibited by law just the same as opposite-sex sexual harassment) but because the harassment has to be ongoing to be considered unlawful. One incident alone wouldn't qualify as sexual harassment (unless the incident is severe).

  • Employers are liable for the sexual harassment of an emeployee by other employees -- and even NON-EMPLOYEES -- if the employer knew of the harassment and failed to take reasonable steps to end it. See EEOC Reg. 29 CFR 1604.11(e). My lawsuit, "Martin v. Howard University," set precedent on this issue in D.C. fed court. When I was a law professor at Howard U, I was stalked by homeless, delusional, serial campus stalker who pursued me to be his "wife." See U-Tube and links at "dvmartinlaw."

  • Sexual harassment is "unwelcome" sexual advances or conduct that is severe or pervasive. When the employee indicates that the conduct is offensive, it must stop. It is not limited to supervisors harassing subordinates. If an employee is harassed by a co-worker -- or a non-employee with access to the workplace -- the employer has a duty to take reasonable steps to end the harassment if the employer knew or should have known about the harassment. See EEOC Reg. 29 CFR 1604.11(e).
