Smoking banned in CUs
Drawing from a constitutional mandate to protect and promote peoples right to health and from the WHO Framework Convention on Tobacco Control and Republic Act 9211 or the Tobacco Regulation Act of 2003, the University of the Philippines has instituted a System-wide ban on smoking and sales and advertising of tobacco.
President Emerlinda R. Roman issued Administrative Order No. PERR-07-70, dated September 5, 2007, instructing chancellors to impose and maintain immediately a no smoking policy in the entire campuses of UP Baguio, UP Diliman Extension Programs, UP Manila (UPM) and PGH, UPM School of Health Sciences in Palo, Leyte, UP Visayas (UPV) Cebu College, UP Open University, and UPV Tacloban College. Any smoking area should be outside these campuses.
Chancellors of large campuses—UP Diliman, UP Los Baños, UPV Miagao, Iloilo, and UP Mindanao—were instructed to submit a smoking cessation plan which will implement the no smoking policy in their campuses within three years. In the meantime, all buildings, academic core zones, infirmaries, business concessions, and student tambayans in these campuses should be smoke free.
Deans, directors, and all heads of offices should ensure that all areas inside their buildings, entrances and exits, covered areas, parking lots, patios, and gardens are smoke-free. The officials of the CUs were also allowed to implement a smoking ban within residential areas.
Smoking, which is defined as carrying a lighted cigarette, is prohibited in all public conveyances passing through any area of any campus. A public conveyance may be denied entry into the campus should it be shown that it allowed smoking where UP students, faculty, or administrative personnel are present. All faculty administrators and security personnel are responsible for implementing this provision.
Smoking areas may be designated if they follow certain guidelines. They should be outside the building and academic core zones and should not be located anywhere accessible to the public. They should not be larger than 10 square meters, and no building will have more than one smoking area. They should not be located or designed in such manner as to provide privileged space for conversing, meeting, and sitting. They must have signages containing information—as graphic as possible—of the effect of smoking on health, on others, on children and pregnant women, and on governance.
All campuses will enforce a smoking, sales, and advertising ban within 100 meters of their outer perimeter. No activity sponsored by a tobacco company or advertising a tobacco product may use any space within any campus. All business concessions must execute an undertaking that they will not sell nor advertise any tobacco product.
All campuses must put up notices of the smoke ban and conduct continuing information dissemination programs on the ban, the effects of smoking, and options for smoking cessation. The administrative order also provides for smoking cessation facilities in all existing medical facilities and infirmaries.
Announcements of the ban should be made before all events and university functions. Any student activity should include reminders of the ban in posters, internet postings, brochures, or notices.
Heads of units who fail to implement the order may be charged with grave misconduct. Any student, faculty, or staff member who violates any of the provisions will be charged with simple misconduct for the first offense and grave misconduct for subsequent offenses.
