Beasley Allen Report host Gibson Vance welcomes attorney Richard White to discuss issues surrounding the field of criminal law. White earned undergraduate and graduate degrees in Criminal Justice before earning his J.D. from Cumberland School of Law at Samford University. He began his legal career as a prosecutor with the District Attorney's office in Montgomery County. Since 2005, he has been in private practice as a criminal defense attorney. He and Gibson discuss issues including Miranda rights, clients' rights, and how you should proceed if you are arrested for a crime. He advises people accused of a crime to retain a lawyer to help them navigate the process and ensure they collect as much information as possible to assist in their defense. He explains various steps that a person accused will likely go through, such as a probable cause hearing before a district court judge, a bond reduction hearing, and the Grand Jury process. In the Grand Jury process, the accused will either be indicted and proceed to trial, or "no billed," and the charges dismissed. Clients then will proceed through arraignment, attend a pre-trial status date, where they may plead guilty and possibly settle their case, or let the court know they will move on to trial. He and Gibson also talk about pro bono representation, where an attorney will be appointed to a person who cannot afford one, and White helps define various terms and criteria of criminal law.
