The current position on this case; 19 February 2011
I have asked my MP Andy Love for help several months ago he has not even bothered to answer my e-mail I went to his surgery and spoke to his secretary and have returned every fortnight and have been fogged off every time I go with excuses like they have not had any reply yet from Costco's. But this matter should be dealt with accordingly by the human rights act. a company had breach the health and safety regulations and injured a woman fractured three vertebrae causing a mild brain injury and lost her job her husband had to close down his business to take care of her.
The system in return decided that she did not have the mental capacity to decide whether the amount offered was sufficient, did not want any of her family to have a say in the matter, brought a court appointed solicitor to take over the matter and decided to except the offer and demanded that the injured party had to obtain a psychiatrist report in addition, to obtain a penny that was due to her, after they have decided what she deserved. At this stage the case has ended she is now on trial to produce a report on her present mental capacity, because we believe that we the claimant is not on trial and since the case is over and has all the reports from no less than five consultants not including the NHS. Why on earth does our society have to put an injured party true such punishment when they are totally innocent, and the defendant has accepted liability within the first month of the accident? If we cannot get justice from a clear and cut case like this how on earth are we ever going to sue insurance companies corrupted solicitors that require a lot of legal proof.

Also, I agree with Wrongway's conclusion that a judicial search for truth far outclasses adversarial approaches.
The latter have degenerated from the intended test of intellectual validity to discern the truth, to bullying, intimidation, and abuse of a person just to beat them down. And this is called truth! It is a mockery and abuse of a system supposed to render justice.
It is at its worst when full-on adversarial tactics are used against injured and sick people to try to prove they are "unworthy," wha an irony by hired mercanaries, with all the disproportion of a canon ball against an ant.
Lawyers as a profession lost me when a union law firm (but open for all business clearly) worked for an employer to unfairly dismiss the same union's members. It was given the "genteel" misnomer of "redundancy." Those in charge at the employer were lawyers too, for reasons unclear as the work had nothing to do with law.
The union members couldn't get the firm's help as it would have been a conflict of interest.
And lawyers wonder why they're not respected no matter how much money they make. Unfortunately for the decent ones, the weeds have taken over the garden in the public's esteem. They are just seen as chasing money with no regard to morality or the common good.
What a foolish thing to squander a title like "learned profession" by behaving as too many lawyers have, now giving the impression of a bad tree not just a bad apple.
For most people, the outcome is no access to the law when it is needed, so the law is certainly no longer serving the society.

∑ There is a perception by practitioners of a reluctance by judges to impose sanctions for non-compliance with the requirements of pre-action protocols. If this is correct, then the value of protocols will obviously be undermined and practitioners will lose confidence in them. We suggest that it might be appropriate for the LCD to commission some research on this area.

So sorry to hear of your lady and your problems, single mother going through same in Australia after multiple spinal injuries in car accident, 8 years on not treated and doctors conflicting with each other tying me in knots and stopping me getting help. It is only as they do not want to pay a settlement. Evil is as evil does. Prayers to you both!

@kezzartdaly This is what I have experience not only one have to succumb the accident but also the deprivation of the health care that one should have received because of higher management in the health service, blocking the right of treatment for the accident that the claimant was entitled too, in some ways that is worse than the accident itself, our society has reached the ultimate point of total corruption. Did you not get a lawyer? This doesnt sound like something Jim Senigal would EVER let slide. I dont understand why Costco just didnt cut you guys a check for a couple million and call it a day...

Lostpaladdin, we have had three different lawyers on this case, Solicitors in the U.K. lick the arse of huge corporate like Costco, come to think of it the whole infrastructure evolves serving the corporate machine no one can be trusted. The corporate machine has bought the soul of our society and it is accepted as normal amongst the people who know. Personal injury firms should not be allowed to work for businesses.
