CINCINNATI (WKRC) -- On the heels of a memo from the Justice Department ordering the recognition of same-sex unions in federal law, a local attorney files suit on behalf of married same sex parents.Al Gerhardstein announced today details of his suit that seeks to require the state of Ohio to place the names of married same-sex parents on the birth certificates of their children. Plaintiffs in the suit include three lesbian couples married in states where same-sex marriage is legal as well as a gay couple married in New York and the adoption agency that helped them adopt a child born in Ohio. We are following in the footsteps of the Obergefell case, because if you get a ruling that says you shouldn't discriminate on death certificates, we ought to get a ruling that you can't discriminate on birth certificates, as well, says Gerhardstein. Gerhardstein recently represented Jim Obergefell and John Arthur, a gay couple married in Maryland and living in the Tri-State. He saw to it that the state of Ohio would allow John to be listed as Arthur's spouse on Arthur's death certificate, even though Ohio does not recognize gay marriage.
