Individual retirement accounts (IRAs) and 401Ks should almost never be paid to an estate or trust because of how the IRS will tax the beneficiaries. Find out what to do when an IRA or 401K is payable to an estate trust from an estate planning and probate lawyer in this free video on estate law.

  • Very informative. In our case, our father left the 401k beneficiary blank, his pourover will should have put it into his trust as he intended, but the company he worked for filled in the beneficiary for him after death. They filled in his "spouse" (a caregiver who swindled him and the family) as the beneficiary. A good lawyer will help with the planning details. A cheap lawyer will cost your heirs.
