I don't feel bad for her in the least. She could have killed someone because she was stupid, drank too much and drove. HER fault. If I'm the judge I drop the lawsuit and tell the bailiff to drag her paralyzed ass to jail.

You see, here's the point. If this woman got drunk and ran somebody else down and paralyzed them, *that* person, I believe could not only sue her, but might very well have a *some* case against the bartender, first because the bartender is legally required to check I.D.s, and second, because bartenders aren't supposed to serve patrons who are drunk.

But *she* shouldn't be able to sue him on that basis because they both have dirty hands and hers are much dirtier.

She knows its illegal. She walked into the bar knowing it was illegal which means she knew the danger of drinking to herself if she got into the car.

As for blood alcohol level machine, if the gov makes them impliment and force people to use it, then I would agree, bartender or bouncer is responsible for that, but thats different than them having to make judgment themselves and know what the person will do out the door.
