What if that same cop wanted you do get out of the car and give you a field sobriety test, a test maybe based on your height weight, or medical condition made it impossible for you to take the test? If that's the only test the cop gave you, since he or she is not required to give you the breath test, and you failed. You would not be so quick to give up your rights.

You are all missing the point. Common over the counter medications can spike the DataMaster. Drinking and Driving is not illegal by itself. You have to be over the legal limit. What Mr. Barone is asserting is that it is possible to be under the limit, but the results show you are over the legal limit. These tests are not infallible. This area of the law is very scientific. What if you swerved to hit a deer and the cop pulled you over, suspected you were drinking?

Drinking and driving by itself should not be a crime.
If one inflicts bodily harm on another person while driving or to their property that should be the crime that the driver should be punished on.
